Note two things. One: This video was not released until after the elections were over. This kept 911 from becoming a topic during the days leading up to the election. Two: The reporter does NOT mention who the FOIA lawsuit was by. The plaintiff was Flight77.Info. The defendant was (of course) the FBI.
